All work supervised by a Solicitor/Director, who has overall responsibility and conduct of matters

It is estimated that this work will take an average of 30 hours. For employee, we will consider whether a case is suitable for an Agreed Fee Agreement or Damages Based Agreement (DBA) or Home Insurance legal cover. For DBA, you may be responsible to pay disbursements i.e., expert, counsel, others, For Home Insurance legal cover, you may not pay anything. The employer is by Agree Fee Agreement.

The fee arrangement will often depend on the circumstances in your case. These circumstances are inexhaustive such as:

  • Volume of supporting evidence that we will peruse and prepare
  • Number of witnesses and complexity of the case
  • Quantum of drafting to be carried out
  • Negotiations and with ACAS
  • Duration and types of the hearings – preliminary hearing
  • Delay and failure of a client or other parties to cooperate
  • Unforeseen circumstances

  • Determining prospect of success and the level of damages – worth of the claim
  • Negotiating with ACAS and with the employer

  • Instructing our in-house advocates
  • Considering and advising on Employment Tribunal documents.

  • Employment Tribunal costs orders made against you

  • Enforcement of any order

Timescales

Usually, unfair dismissal and wrongful dismissal cases take between one month to one year from instructions to conclude. However, most cases have an initial time limit of three months minus one day to bring the claim to an Employment Tribunal. Meanwhile, some wrongful dismissal cases can be brought to the County Court where the time limit is six years.

Once the Tribunal has concluded hearing the claim, the Employment Tribunal Judge may reserve judgement to another date and may list separate remedy hearings. These listings will also affect the duration.

Complaints Handling Policy
